Consumer Privacy Policy

  2. FADS is committed to preserving and safeguarding your right to privacy. As evidence of this commitment, we have implemented the following Privacy Policy (the "Policy"), which complies with or exceeds the requirements of the federal Personal Information Protection and Electronic Documents Act, also known as "PIPEDA". This Policy sets out the manner in which FADS collects, uses, discloses and manages your Personal Information. References in this Policy to "we", "our", or "FADS" are references to F.A. Dance Studios (Canada) Ltd., its affiliated corporations and its franchisees unless otherwise indicated.

    This Policy is designed to assist our franchisees, employees, and customers in understanding how we collect, store, use, disclose, protect and ensure the accuracy of information collected and controlled by FADS. It also applies to all Personal Information held in FADS' databases and utilized by our franchisees and employees.

The Personal Information Protection and Electronic Documents Act became enforceable in respect of the public sector in Canada on January 1, 2004, to ensure that information that individuals provide in commerce as any form of "record", including photographs, commentary, or factual information, is used in an appropriate manner, with their consent, and properly protected by those to whom the Personal Information is given. The legislation defines Personal Information as "information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization". In other words, it is information particular to an individual that would allow them to be identified. This would include your name, residential address, and e-mail address (as), telephone number, credit card particulars, and your personal purchasing history.

    Below, you will find particulars about how and what kind of Personal Information we collect. These descriptions are of a general nature and are not intended to be comprehensive nor to limit the scope of the definition of Personal Information as used by PIPEDA.

    Website: FADS may collect information about you when you register to become a registered user of the Website. In addition, FADS keeps a record of the e-mall addresses of those who communicate with us via the various e-mail sections of the site. FADS also collects both aggregate and user-specific information on what pages consumers access or visit, and information volunteered by the consumer, such as survey information, general inquiries, enrollment, franchising and employment information and applications.

    Complaints: FADS may collect information about you if you contact FADS with a consumer complaint or request. This information may include your name, address, telephone number, e-mail address, date of birth and specific facts regarding the complaint or request.
    Contests and Promotions: FADS may collect information about you if you participate in any FADS contest or promotion. The information collected may include your name, address, telephone number, e-mail address, date of birth, and any other specific facts relevant to the contest or promotion participation.

FADS uses your Personal Information for one or more of the following purposes (1) to identify who you are; (2) improve the content of the Website; (3) to personalize the content or layout of the Website for consumers; (4) to notify consumers of updates to the Website; (5) to contact consumers for marketing purposes; (6) to improve its products and services; (7) to process and ship your order for products; (8) to determine a potential franchisee's credit-worthiness or for the preparation and/or registration of documents needed to grant a franchise to an individual; or (9) process consumer complaints and requests.

FADS may also disclose Personal Information to third parties who administer contests, promotions and on-line activities on its behalf. FADS may be required to provide your Personal Information in response to a search warrant, legislation, any legally valid inquiry or binding court order, to an investigative body in the case of breach of agreement or contravention of law, or otherwise as required by law or government regulation. FADS may also disclose Personal Information to assist it in collecting a debt owed by you to us.

However, you should be aware that the Internet is not a secured medium. Therefore, FADS does not represent or warrant the complete security of the Personal Information provided by you to FADS through the Website. You understand you are providing such information to FADS at your own risk.

    We employ ongoing security measures in an effort to protect Personal Information held by us from unauthorized use, access, disclosure, distribution, loss or alteration. Your Personal Information is protected by implementing the following kinds of safety precautions, as may be required:

    1. physical, such as the locking of filing cabinets or restricting access to certain areas of our offices to appropriate personnel;
    2. administrative/organizational, such as the implementation of proper policies to be followed by all FADS employees, agents, franchisees and affiliates, and to ensure that they are trained to know their ongoing obligations to you. Employees, agents, franchisees and affiliates are provided with only the Personal Information that is necessary for them to perform their duties properly and with no other Information or for any other purpose, and
    3. technological, such as the utilization of passwords, encryption, and secure servers on all of our computers and/or electronic databases.


    Personal Information is stored on-site at our franchisees' places of business, on-site at the locations of any corporate-owned studio locations, and/or at FADS' head offices in London, Ontario, Canada.

  15. Amendment to the FADS Privacy Policy


  16. FADS reserves the right to, in its sole discretion, modify the Policy at any time without notice to you. The then-current Policy shall be posted on the FADS website located at www.fredastaire.ca and any other website (individually and collectively, the "Website" operated by or affiliated with FADS.

    It is your responsibility to be aware of the terms of the then-current Policy. You agree that your use of the Website will at all times be subject to the terms of the posted Policy and that such use constitutes your consent to the Policy. The Website may contain links to other websites not necessarily endorsed by FADS, and as such, FADS will not be responsible for the privacy practices of any site that you choose to view that are not subject to the Policy, nor any damages or losses that may be suffered by you as a result.

  18. You are entitled to know what Personal Information about you that we have collected, as well as how it has or will be used. If you provide a written request for this information, we will provide it to you within 60 days of confirmation of your identity. We will inform you whether or not we hold Personal Information about you and, when possible, the source of the Information, its use, and any parties to which it may have been disclosed.

    You may be required to provide sufficient proof of your identity at the time of making a request to ensure the safety and security of the Information we hold and that it is provided to select individuals in accordance with this Policy. In the event that we cannot provide a complete list of the Personal Information that we have collected about you, we will provide you with the reasons why your access to this information is being denied.
